Information on the Additional Extension of Emergency Unemployment Compensation (EUC) Benefits

On November 21, 2008, the President signed into law an expansion of the Emergency Unemployment Compensation (EUC) program. The new law provides that:

Individuals currently drawing benefits from the original EUC extension, or who have exhausted their initial EUC claim, may be potentially eligible to receive:
  • First-Tier EUC Benefits: Provides up to 7 additional weeks of EUC benefits; and
  • Second-Tier EUC Benefits: Provides up to 13 additional weeks of EUC benefits once their First-Tier EUC benefits are exhausted and a new regular unemployment insurance (UI) claim cannot be established.
Individuals currently receiving regular unemployment insurance (UI) benefits may be potentially eligible to receive:
  • First-Tier EUC Benefits: Provides up to 20 weeks of EUC benefits once their regular UI benefits are exhausted; and
  • Second-Tier EUC Benefits: Provides up to 13 additional weeks of EUC benefits once their First-Tier EUC benefits are exhausted and a new regular unemployment insurance (UI) claim cannot be established.
All individuals who filed an original EUC claim before the enactment of the new law will have their claims recalculated and sent a First-Tier EUC Monetary Redetermination. The new calculation will equal up to 80% of the individual's original maximum benefit amount (MBA), up to 20 weeks. The MBA balance may be reduced by the amount of EUC payments previously paid. Individuals will be paid the same weekly benefit amount (WBA) allowed on their most recent claim. The first payable week of First-Tier EUC will be the week of November 23–29, 2008.

All individuals who meet the requirements of the new legislation will be notified by mail within 10 days with the instructions on how to apply and claim the additional First-Tier EUC benefits. There is no need to call or visit your local career center, unless asked to do so by your career center staff.

Moving forward, individuals who exhaust their First-Tier EUC claims, will be notified by mail of their potential eligibility of Second-Tier EUC benefits and provided with instructions on what they need to do to receive these benefits. Individuals who become eligible for a new regular UI claim while receiving First-Tier EUC or Second-Tier EUC benefits, will be notified of the action necessary to continue to receive benefits.
