Public Law 111-5, the American Recovery and Reinvestment Act of 2009
On February 17, 2009, President Obama signed Stimulus Public Law 111-5, the American Recovery and Reinvestment Act of 2009. The new law includes provisions in the following areas for unemployment compensation:
Emergency Unemployment Compensation (EUC) Program: Regular unemployment benefits must exhaust by December 31, 2009 to potentially be eligible to receive EUC. No extended benefits can be paid after week ending date May 29, 2010.
Temporary Federal Additional Compensation (FAC) Program: Individuals receiving Unemployment Insurance (UI) benefits, i.e. regular UI, EUC and Trade Readjustment Assistance (TRA) will receive temporary FAC supplemental pay of $25 a week. The FAC supplement will be paid weekly for each week that individuals are eligible to receive UI benefits. The first payable week is week ending date February 28, 2009. The last payable week is week ending date July 3, 2010. FAC payments will only be made on claims with a benefit year beginning date prior to January 1, 2010.
Suspension of Federal Income Tax of UI Benefits: Federal income tax will be temporarily suspended on the first $2,400 of unemployment benefits paid to each individual.
Public Law 111-5, the American Recovery and Reinvestment Act of 2009, does not include provisions for additional extended benefits beyond Second-Tier EUC.
